Planting a smoke bomb in a public place is a crime that is considered dangerous to human life, HT admitted his intent to intimidate or coerce a civilian population, and he conspired with Phil to commit the act on US soil. At the very least he’s guilty of conspiracy to commit terrorism, good for a ten year stretch in federal prison.
It would also fall under ORC 2917.12: disturbing a lawful meeting; ORC 2917.31: inducing panic; ORC 2917.33: Unlawful use or possession of a hoax weapon of mass destruction; ORC 2923.01: conspiracy; ORC 2909.06: criminal damaging or endangering; ORC 2909.07: criminal mischief; and ORC 2921.321: assaulting or harassing a police dog or horse, or a service dog
